Terms and Conditions

1. Seller and Acceptance

These Terms govern the use of the BoostSEO platform ("Service"), provided by Boost360 DH ("we", "Seller"). By using the Service, the user fully accepts these Terms.

2. Description of the Service

BoostSEO.ai is a SaaS platform that provides analysis tools, automation, and SEO suggestions based on AI. The Service does not guarantee specific ranking results on Google or other search engines.

3. Accounts and credentials

The user is responsible for the accuracy of provided data, the confidentiality of their credentials, and all activities performed under their account. The user declares they have the legal capacity to enter into this contract or, if acting on behalf of an organization, that they have the authority to do so.

4. Acceptable use

It is forbidden to use the Service for: (a) illegal, fraudulent, or spam activities; (b) violation of intellectual property rights of third parties; (c) uploading malware or attempts to compromise security (probing, unauthorized scraping, reverse engineering); (d) resale or redistribution of the Service without authorization; (e) circumvention of technical limits of the plans.

5. Intellectual property

All intellectual property rights related to the Service (software, documentation, trademarks, design) remain the exclusive property of Boost360 DH. The user is granted a limited, non-exclusive, and non-transferable license to use the Service within the limits of the subscribed plan.

6. Payments and subscriptions — Paddle Merchant of Record

The order process is managed by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles customer support for orders and refunds.

Payment, billing, tax, renewal, and cancellation conditions are governed by the Paddle Buyer Terms. Subscriptions renew automatically at the end of the chosen period, unless canceled via the customer portal.

7. Refunds

Our refund policy is described in the Refund Policy. Refunds are managed by Paddle via boostseo.ai.

8. Service level and guarantees

The Service is provided "as is". We do not guarantee that the Service will be uninterrupted or error-free. To the extent permitted by law, we exclude all implied warranties of merchantability or fitness for a specific purpose.

9. Limitation of liability

To the extent permitted by law, the aggregate liability of Boost360 DH shall not exceed the amounts actually paid by the user in the 12 months preceding the event. Indirect, consequential, or special damages (loss of profits, data, goodwill) are excluded. Liability for intent, gross negligence, death, or personal injury remains valid where mandatory by law.

10. Suspension and termination

We may suspend or terminate access to the Service in case of: (a) material breach of these Terms; (b) non-payment; (c) security risk or fraud; (d) repeated or serious violations of our policies. Upon termination, user data will be available for export for 30 days and then deleted.

11. AI Content and user responsibility

The Service generates content via artificial intelligence. It is prohibited to use it to generate illegal content, deepfakes, hate speech, malware, or to bypass security measures. Users are responsible for their prompts, the use and verification of generated content, and for ensuring they hold the rights to uploaded content. AI results may be inaccurate and do not constitute professional advice (legal, medical, financial). Boost360 DH may remove content, filter outputs, and suspend accounts in case of abuse or reported third-party rights violations.

12. Changes

We may update these Terms. Substantial changes will be communicated via email or through the dashboard with reasonable notice.

13. Governing law and jurisdiction

These Terms are governed by Italian law. For any controversy, the court of the place of residence of the consumer is competent, where provided by applicable legislation.
